Important Bankruptcy Paperwork You’ll Need for Your Case
During the process of filling out your bankruptcy paperwork, you’ll be required to provide information about your finances, including your various assets, expenses, income sources and property transfers. There are also other documents you’ll have to provide to the bankruptcy trustee to back up any information you provide on the forms you’ll submit to the court.
The types of documents you need to turn in can vary slightly depending on whether you’re filing for Chapter 7 or Chapter 13 bankruptcy, but most of the paperwork you’ll need to collect and submit will be the same. Here’s a quick overview from a bankruptcy attorney about the commonly required bankruptcy paperwork in Montgomery County, TX that you’ll need to submit in your case:
- Proof of income: You’ll need some form of income documentation to verify how much money you make. This will include W-2 forms and pay stubs, likely for at least a six-month period. The court may request other documentation to verify your income from sources such as rental properties, disability or Social Security. If you’re self-employed, this can be a bit trickier—you’ll need to provide profit and loss statements for the last couple years, and business bank statements as well.
- Tax returns: You will typically be required to submit copies of tax returns for the last two years in a Chapter 7 bankruptcy and the last four years in a Chapter 13 bankruptcy. You’ll need to explain the existence of unfiled returns if you have any. You may be required to file unfiled returns before the bankruptcy case can proceed, depending on your reasons for not filing them previously.
- Vehicle information: You’ll need to submit proof of your vehicle’s value, as well as loan documentation, vehicle registration information and proof of insurance.
- Real estate: If you own real estate, you’ll need to provide proof of the value of the property. You can get a full appraisal if you wish, but you can also simply get an opinion from a certified broker, or an online valuation of your property. You’ll also likely be asked to provide information about the current balance of your loan and how much you’re paying toward the loan each month. You may be asked for proof of home insurance and the deed of trust.
- Account statements: You will be required to provide the bankruptcy trustee with statements for your bank and retirement accounts.
- Other documents: Some other types of documents you might be asked to provide include information about alimony or child support, valid photo identification, proof of a Social Security number and anything else that provides context as to the circumstances affecting your bankruptcy and your general financial situation.
